Terms and conditions of use


The General Conditions of Use (GCU) are a legal contract between the user (you) and GeniWal. By using our services, you accept the conditions of use set out below.

Terms and conditions of use

ARTICLE 1: Purpose

The purpose of these "general conditions of use" is to provide a legal framework for the use of the Geniwal site and its services.

This contract is concluded between :

The manager of the website, hereinafter referred to as "the Publisher",

Any individual or legal entity wishing to access the site and its services, hereinafter referred to as the "User".

The general conditions of use must be accepted by all Users, and access to the site implies acceptance of these conditions.

ARTICLE 2: Legal information

The Geniwal website is published by Yves Heraly, domiciled at Moerlaanstraat, 19 3090 Overijse.

ARTICLE 3: access to services

Users of the Geniwal site have access to the following services:
- Geniwal's publications
- The Isadora search service for non-members
- Geniwal's shop
- Publication of the Visitors' Genealogy

Any User with Internet access may access the Site free of charge from anywhere. The Publisher shall not be liable for any costs incurred by the User in accessing the site (internet connection, computer equipment, etc.).

The following services are not accessible to Users unless they are members of the site (i.e. identified using their login details):
- Seizures of acts on Isadora
- Has more than 2 searches for acts in Belgium
- Access to dates, towns and details of acts on Isadora

The Website and its various services may be interrupted or suspended by the Publisher, in particular for maintenance purposes, without any obligation to give prior notice or justification.

ARTICLE 4: Responsibility of the User

The User is responsible for the risks associated with the use of his/her login and password.

The User's password must remain secret. In the event of disclosure of the password, the Publisher declines all responsibility.

Users assume full responsibility for their use of the information and content on the [your site] website.

Any use of the service by the User resulting directly or indirectly in damage must be compensated by the site.

The site allows members to publish on the site:
- New publications;
- Addition of acts on Isadora ;

The member undertakes to use language that is respectful of others and of the law and accepts that such publications may be moderated or refused by the Editor, without any obligation to justify their actions.

By publishing on the site, the User grants the publishing company the non-exclusive and free right to represent, reproduce, adapt, modify, broadcast and distribute his/her publication, directly or through an authorised third party.

However, the Publisher undertakes to cite the member in the event of use of its publication.

ARTICLE 5: Liability of the Publisher

The Publisher cannot be held liable for any server or network malfunction.

Similarly, the site cannot be held liable in the event of force majeure or the unforeseeable and insurmountable act of a third party.

Géniwal undertakes to use all necessary means to guarantee the security and confidentiality of data. However, it does not guarantee total security.

The Publisher reserves the right not to guarantee the reliability of the sources, although the information published on the site is deemed reliable.

ARTICLE 6: Intellectual property

Geniwal content (logos, text, graphics, videos, etc.) is protected by copyright under the French Intellectual Property Code.

The User must obtain the site editor's authorisation before reproducing, copying or publishing any of this content.

These may be used by users for private purposes; any commercial use is prohibited.

Users are entirely responsible for any content they post online and undertake not to harm any third party.

The Site Editor reserves the right to moderate or delete content posted by users at any time and without justification.

ARTICLE 7: Personal data

The User must provide personal information in order to register on the site.

The user's e-mail address may be used by Géniwal to communicate various information and manage the account.

Géniwal guarantees respect for the user's privacy, in accordance with law n°78-17 of 6 January 1978 relating to information technology, files and freedoms.

In accordance with articles 39 and 40 of the law dated 6 January 1978, the User has the right to access, rectify, delete and object to his/her personal data. The User may exercise this right via :

- Your personal space on the website;
- A contact form;
- By e-mail to geniwal@gmail.com ;
- By post to 24 place de la Cure, 1300 Wavre.

ARTICLE 8: Hypertext links

The domains to which the hypertext links on the site lead are not the responsibility of the Editor of Géniwal, who has no control over these links.

It is possible for a third party to create a link to a Géniwal page without the express authorisation of the publisher.

ARTICLE 9: Changes to the general terms and conditions of use

Géniwal reserves the right to modify the clauses of these general conditions of use at any time and without justification.

ARTICLE 10: Duration of the contract

The duration of this contract is indefinite. The contract takes effect with regard to the User from the start of use of the service.

ARTICLE 11: Applicable law and jurisdiction

This contract is governed by French law.
In the event of a dispute between the User and the Publisher that cannot be resolved amicably, the courts of Wavre shall have jurisdiction to settle the dispute.
