These general terms and conditions of sale (hereinafter the "GTC") define the reciprocal rights and obligations in the event of the purchase of products or services on the Géniwal a.s.b.l. online shop platform by a User (hereinafter the "Customer").

GENERAL TERMS AND CONDITIONS OF SALE

1. Scope of application

These general terms and conditions of sale (hereinafter the "GTC") define the reciprocal rights and obligations in the event of the purchase of products or services on the Géniwal a.s.b.l. online shop platform by a User (hereinafter the "Customer"). The GTC express the entirety of the obligations of the parties. The Customer is deemed to accept them without reservation, failing which his order will not be validated. In exceptional circumstances, derogations may be made to the provisions of the GCS, provided that such derogations have been agreed in writing. These deviations may consist of the modification, addition or deletion of the clauses to which they refer and have no effect on the application of the other provisions of the GCS. Géniwal a.s.b.l reserves the right to modify the GCS from time to time. The modifications will be applicable as soon as they are put online for all purchases made after that date.

2. Online shop

Géniwal a.s.b.l fournit au Client une boutique en ligne présentant les produits ou services vendus, sans que les photographies aient une valeur contractuelle. Les produits ou services sont décrits et présentés avec la plus grande exactitude possible. Toutefois, en cas d’erreurs ou omissions dans la présentation, la responsabilité du Géniwal a.s.b.l ne pourra être engagée de ce fait. Les produits et services sont proposés dans la limite de leur disponibilité. Les prix TVA incluse sont précisés dans la boutique en ligne.

3. Awards

Géniwal a.s.b.l reserves the right to modify its prices at any time by publishing them online. Only the prices indicated and the taxes in force at the time of the order will apply, subject to availability on that date. Prices are given in euros and do not include any delivery charges, which are indicated and invoiced in addition before the Customer confirms the order. The total amount of the order (including all taxes) and, where applicable, delivery costs is indicated before final validation of the order form.

4. Online ordering

The Customer may fill in an order form online, using an electronic form. By completing the electronic form, the Customer accepts the price and description of the products or services. For the order to be validated, the Customer must accept these GCS by clicking where indicated. The Customer must provide a valid e-mail address, billing address and, if applicable, delivery address. All exchanges with Géniwal a.s.b.l. can take place via this e-mail address. In addition, the Customer must choose the delivery method and validate the payment method. Géniwal a.s.b.l reserves the right to block the Customer's order in the event of non-payment, incorrect address or any other problem with the Customer's account until the problem is resolved.

5. Order confirmation and payment

Géniwal a.s.b.l remains the owner of the items ordered until full payment has been received.

a. Payment

The Customer makes the payment at the time of the final validation of the order using the chosen method of payment. This validation takes the place of a signature. The Client guarantees Géniwal a.s.b.l that he has the necessary authorizations to use this method of payment and acknowledges that the information given to this effect is proof of his consent to the sale as well as the due date of the sums owed for the order. Géniwal a.s.b.l. has set up a procedure for verifying orders and means of payment in order to reasonably guarantee against any fraudulent use of a means of payment, including asking the Customer for identification data. In case of refusal to authorize payment by credit card by accredited organizations or in case of non-payment, Géniwal a.s.b.l reserves the right to suspend or cancel the order and its delivery. Géniwal a.s.b.l. also reserves the right to refuse an order from a Customer who has not fully or partially settled a previous order or with whom a payment dispute is in progress.

b. Confirmation

The Customer may request that the invoice be sent to an address other than the delivery address by sending a request to this effect to Géniwal a.s.b.l: e-mail to geniwal@gmail.com before delivery. If a service or product is unavailable, Géniwal a.s.b.l. will inform the Customer by e-mail as soon as possible in order to replace it or cancel the order for this product and possibly refund the related price, the rest of the order remaining firm and definitive.

6. Proof

Communications, orders and payments between the Client and Géniwal a.s.b.l. can be proven by computerized records kept in Géniwal a.s.b.l.'s computer systems under reasonable security conditions. Order forms and invoices are archived on a reliable and durable medium considered, in particular, as a means of proof.

7. Delivery

Delivery is only made once payment has been confirmed by Géniwal a.s.b.l.'s bank.

Les frais supplémentaires découlant d’informations incomplètes ou erronées par le Client lui seront facturées. Pour des raisons de disponibilité, une commande pourra faire l’objet de plusieurs livraisons successives au client. La livraison intervient, selon le mode choisi par le client, dans les délais suivants : Les délais de livraison sont donnés à titre indicatif. Aucune indemnité ne pourra être réclamée à Géniwal a.s.b.l ou au transporteur en cas de retard de livraison. Si les délais de livraison dépassent trente jours à compter de la commande, le contrat de vente pourra toutefois être résilié et le client remboursé.

a. Checking the order

Upon receipt of the products, the Customer or recipient checks the good condition of the product delivered or the conformity of the service provided. In the event that one or more of the products ordered are missing or damaged, the Customer or recipient must immediately inform Géniwal a.s.b.l. at the time of delivery. Verification is considered to have been carried out as soon as the Customer or a person authorised by him has received the order without expressing any reservations. Any reservations not made in accordance with the rules defined above and within the time limits set will not be taken into account and will release Géniwal a.s.b.l. from any responsibility towards the Client.

b. Delivery error

In the event of a delivery error or non-conformity of the products with the information on the order form, the Customer must inform Géniwal a.s.b.l. within three working days of the delivery date. Any claim not made within the time limit will not be taken into account and will release Géniwal a.s.b.l. from any responsibility towards the Customer.

c. Retours et échanges

Le produit à échanger ou à rembourser devra être retourné a Géniwal a.s.b.l dans son ensemble et dans son emballage d’origine, selon les modalités suivantes : Toute réclamation et tout retour non effectué dans les règles définies ci-dessus et dans les délais impartis ne pourra être pris en compte et dégagera Géniwal a.s.b.l de toute responsabilité vis-à-vis du Client. Tout produit à échanger ou à rembourser devra être retourné à Géniwal a.s.b.l dans son ensemble et dans son emballage d’origine.

8. Guarantees

Géniwal a.s.b.l. guarantees the conformity of the products or services to the contract in accordance with the law in force at the time the contract is concluded.

9. Right of withdrawal

Le Client pourra faire valoir son droit de rétractation légal dans un délai de 14 jours ouvrables suivant la livraison du bien ou la conclusion du contrat de service. Après avoir communiqué sa décision de se rétracter, le Client dispose alors de 14 jours pour renvoyer ou restituer les biens. Toute rétractation non effectuée selon les règles et les délais définis par le présent article ne pourra être prise en compte et dégagera Géniwal a.s.b.l de toute responsabilité vis-à-vis du Client. Le retour ou l’échange du produit ne pourra être accepté que pour les produits dans leur ensemble, intacts et dans leur état d’origine, en particulier avec un emballage complet, intact et en état de vente. Géniwal a.s.b.l devra rembourser le Client de la totalité des sommes versées, y compris les frais de livraison, dans les 14 jours de la récupération des biens ou de la transmission d’une preuve de l’expédition de ces biens.

If the order relates, in whole or in part, to digital content not supplied on a physical medium, the Customer hereby agrees to forfeit, in respect of such digital content, his right of withdrawal in order to receive delivery as soon as possible.

En cas de litige seul le tribunal de commerce de Nivelles est compétant.
